RELEASE AND WAIVER OF LIABILITY

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION.

In consideration of Refrigerative Supply Limited, and its officers, directors, board members, employees, agents and assigns (collectively, “RSL”) permitting me to attend and/or participate (“Participate”) in [INSERT NAME OF EVENT] on [INSERT DATE(S)] (hereinafter referred to as the “Event”, which shall include any activities related to the Event), I (print participant name) _____________________________(“Participant” “I” “my” or “myself”), confirm and acknowledge that I have voluntarily elected to Participate in the Event and agree to the terms and conditions set out in this release and waiver of liability (the “Agreement”).
I hereby voluntarily agree to waive, release, forever discharge, indemnify, hold harmless and promise not to sue, in each case RSL, from, against and in respect of any and all Claims (as defined below) that may directly or indirectly arise out of, result from, relate to, or are in any way connected to my Participation in the Event, including, but not limited to any such Claims that allege negligent acts or omissions by RSL.
I acknowledge and fully understand that my Participation in the Event and transportation to and from the Event (if any) may entail known, unknown, and unanticipated risks that could result in property loss or damage, injury to myself or others, including death. I understand that such risks cannot be eliminated. I elect to Participate in the Event in spite of the risks. I expressly agree to accept and assume full responsibility for all such risks as they relate to my Participation in the Event.
I agree that while Participating in the Event my safety is primarily dependent upon my taking proper care of myself. I agree to make sure that I understand how to safely Participate in the Event by becoming familiar with and strictly observing any safety rules and practices employed to minimize risks while Participating in the Event. I agree to stop and seek assistance if I do not believe I can safely continue to Participate in the Event. I will not wear or use or do anything that would pose a hazard to myself or others, including using or ingesting any substance which could pose a hazard to myself or others. I agree that if I do not act in accordance with this Agreement, I may not be permitted to continue to Participate in the Event.
If I become separated from the Event group, fail to return with the group or become sick or injured, I will, to a reasonable extent, and at my own expense, provide for my own transportation back to the point of departure of the Event.
I certify that I have no medical or physical conditions that could interfere with my safety while Participating in the Event and that I have not been advised to not Participate in the Event by a qualified medical provider. I recognize that RSL is not obligated to attend to any of my medical or medication needs. I agree to assume all risk and responsibility and to pay all such expenses relating thereto.
I understand that RSL is not an agent of or for any third party that may provide goods or services associated with the Event, including, but not limited to food, beverages, accommodation, travel, equipment or the use of property and/or facilities.
Should RSL, or anyone acting on their behalf, be required to incur legal fees and costs to enforce this Agreement, I agree to indemnify and hold them harmless for all such fees and costs.
The term “Claims” includes any and all claims, liabilities of every kind, demands, damages (including direct, indirect, incidental, special and/or consequential), losses (economic and non-economic), and causes of action, of any kind or nature, which I have or may have in the future (including, but not limited to, court costs, legal fees and litigation expenses), which may arise out of, result from, relate to, or are in any way connected to my Participation in the Event. I acknowledge and understand that these Claims include, but are not limited to, Claims for death, personal injury, partial or permanent disability, negligence, and property damage or theft; Claims relating to the provision of first aid, medical care, medical treatment, or medical decisions; and Claims for medical or hospital expenses.
I agree that this document shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, and that the courts of the Province of British Columbia shall have exclusive jurisdiction in respect of any disputes or matters hereunder.
I agree that if any term of this Agreement is found to be void or unenforceable, the remaining terms shall remain in full force and effect.
Personal image use release - I hereby grant permission to RSL to take and use photographs of me and my Participation in this Event and to publish them in print or electronically without my further consent and without any recourse or compensation to me. For greater clarity, such photographs will be the property of RSL and may be used in promotional material, websites or in any other way without liability on the part of RSL or on the part of the media in which such photographs may appear.

By signing this Agreement, I acknowledge that if anyone is hurt or property is damaged during my Participation in the Event, I may be found by a court of law to have waived my right to maintain a lawsuit against RSL on the basis of any Claim from which I have released them herein.

I have had sufficient opportunity to read this entire Agreement. I have read and understood it, and I agree to be bound by its terms on behalf of myself, my children, my parents, my heirs, guardians, successors, assigns, administrators, executors, personal or legal representatives, and estate.

GUARDIAN’S ADDITIONAL INDEMNIFICATION (Must be completed for Participants under the age of 18)

In consideration of (print name of Minor Participant) ___________________ (“Minor”) being permitted by RSL to Participate in the Event, I further agree to indemnify and hold harmless RSL from any and all Claims brought by or on behalf of the Minor Participant in connection with his/her Participation in the Event.
